The DOT has recently published another change in its regulations which will impact ALL N.C. LICENSEES WHO SHIP RADIOACTIVE MATERIAL or OFFER RADIOACTIVE MATERIAL FOR TRANSPORT The notice was posted in the Federal Register on March 25, 2003 (Vol. 68,
No. 57 pgs 14509 - 14521)
A summary of the key points is noted below: v ALL persons (licensees) who transport or offer for transport, hazardous materials (Class 7 or Radioactive Materials are included here), must demonstrate that all hazmat employees have received security awareness training. v Certain persons (licensees) who transport or offer for transport Class 7 (Radioactive) Materials in the following must implement a written Security Plan and provide In-depth Security Training to its hazmat employees: 1. A summary of the key points is noted below: v Shipping papers (bills of lading) MUST include the date of acceptance by the initial carrier (i.e., the date the shipment was put into transportation). v A single copy of the shipping paper may be maintained for those shipments which use a shipping paper without change (e.g. portable nuclear gauge, XRF, etc.) for multiple shipments of a single hazardous material. However, a record of each shipment made to , including shipping name, identification number, quantity transported and the date of shipment must also be retained. WHAT DOES THIS MEAN TO ME (THE LICENSEE)? v For licensees who ship or offer for shipment radioactive materials which ARE NOT THE SAME FOR EACH SHIPMENT (e.g. unit doses shipped form a radiopharmacy or shipments of radiolabeled compounds), the licensee MUST RETAIN A COPY OF THE SHIPPING PAPER (bill of lading) FOR 375 DAYS AFTER THE SHIPMENT IS INITIATED. This may be either a photostatic or image (scanned document) copy. v For licensees who ship or offer for shipment radioactive materials which ARE THE SAME FOR EACH SHIPMENT (e.g. portable moisture/density gauges), the licensee MAY USE THE SAME SHIPPING PAPER (bill of lading) FOR EACH SHIPMENT PROVIDED THERE IS A RECORD WHICH CONTAINS THE FOLLOWING INFORMATION: w Who the shipment was made
to; v For licensees who ship or offer for shipment radioactive waste, maintain the Uniform Waste Manifest for 375 days, provided it contains the required information. |

OCTOBER 2001 CHANGES Last fall, the U.S. Department of Transportation (DOT) made changes in the regulations contained in 49 CFR 100 - 189. These changes mainly affect licensee's who ship internationally or by air (foreign or domestic). The changes which most effect N.C. Licensees are in the Proper Shipping Name and UN Number designations.
